PRIVACY POLICY OF THE LABOUR PARTY OF SOUTH AFRICA
“The purpose of this Privacy Policy is to set out how, why and when the Labour Party of South Africa (“the Party”) uses your Personal Information in terms of the Protection of Personal Information Act 4 of 2013 (“POPIA”).
This Privacy Policy must be read together with the Party’s Terms and Conditions of Membership, Constitution and any other policies and/or rules in place and as amended from time to time.
IN THIS PRIVACY POLICY:
- “Personal Information” bears the same meaning as set out in POPIA, which includes information in respect of, but not limited to: the biometric information of the person; any identifying number, symbol, e-mail address, telephone number, location information, online identifier or other particular assignment to the person; information relating to the race, gender, sex, pregnancy, marital status of the person; information relating to the education or the medical, financial, criminal or employment history of the person.
- “Special Personal Information” bears the same meaning as set out in Section 26 of POPIA, which includes personal information in respect of, but not limited to: religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, health or sex life.
- “Process/Processing” bears the meaning as set out in POPIA, which includes, but not limited to: the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use of Personal Information.
- PERSONAL INFORMATION:
- The Party processes your Personal Information in a manner that is reasonable, lawful, adequate, relevant and non-excessive.
- Processing of your Personal Information is only initiated upon notification to you of such processing by the Party and your consent which is provided when becoming a member of the Party as per the Party’s Terms and Conditions of Membership, and such Personal Information is only processed for the specific and lawful purpose of the administration of your membership. Should the need arise to further process your Personal Information, we will inform you timeously of such processing and it will still be in the ambits of lawful and purpose-specific processing.
- The Party may collect Personal Information in respect of, but not limited to:-
- Your full name;
- Your identity number and/or passport number;
- Your e-mail address;
- Your contact numbers;
- Your place of residence;
- Your race;
- Your age;
- Your gender;
- Your South African Income Tax Number.
- The Party processes your Personal Information to:
- identify you and verify your identity;
- fulfil its obligations to you;
- conduct its activities as a political party; and
- comply with any legal or regulatory obligations.
- During your membership the Party will retain your Personal Information for as long as:
- You are a member and the Party exists;
- retention is required or authorised by law; or
- you have agreed for a longer retention period of your Personal Information.
- Upon disposal, the Party undertakes to ensure that all reasonable and necessary steps are taken to ensure that your Personal Information cannot be reconstructed in an intelligible form.
- Your Personal Information may also be processed by:
- employees of the Party;
- law enforcement officials and/or third parties where the disclosure of the Personal Information is necessary or appropriate in connection with an investigation of criminal activities or any other activity that is illegal or may expose the Party to legal liability or financial loss.
- If the Party processes your Special Personal Information, the Party undertakes to obtain your consent in order to carry out such processing.
- PROTECTION OF YOUR PERSONAL INFORMATION:
- The Party hereby undertakes to secure the integrity and confidentiality of your Personal Information in its possession or under its control by taking appropriate, reasonable technical and organisational measures to prevent loss of, damage to or unauthorised destruction of your Personal Information; and unlawful access to or processing of your Personal Information.
- In order to implement such measures, the Party has identified all reasonably foreseeable internal and external risks to your Personal Information in the Party’s possession or under the Party’s control; and has established and maintained appropriate safeguards against the risks identified such as:
- Secure storage and destruction of your records of Personal Information; and
- Personal Information breach reporting and remediation.
- Where there are reasonable grounds to believe that your Personal Information has been accessed or acquired by any unauthorised person, the Party undertakes to notify you, in writing, as soon as reasonably possible after the discovery of the compromise
- In the event that the Party, makes use of third parties, who will have access to your Personal Information, the Party will ensure that such third party enters into a confidentiality agreement, and takes the same steps that the Party does, as a minimum, to safeguard your Personal Information.
- YOUR RIGHTS IN RESPECT OF YOUR PERSONAL INFORMATION
- You have the right to view, correct and/or amend your Personal Information that the Party processes.
- You have a right to request a copy or the description of your Personal Information that the Party has in its possession.
- You have a right to request to have your Personal Information corrected, destroyed or deleted.
- To exercise any of the abovementioned rights, you are required to make a written request to the Party’s Information Officer and the Party will take all reasonable steps to confirm your identity before providing details of your Personal Information.
- Please note that any such access request may be subject to a payment of a legally allowable fee.
- The Party undertakes to notify you of the action taken by the Party because of your request, and where such request is not granted, the Party undertakes to inform you of the reasons for refusal.
- You also have a right to object to the processing of your Personal Information, or withdraw your consent to processing.
